The European Commission’s Proposal for a Directive on Corporate Sustainability Due Diligence: an Ever-Expanding Horizon for Disputes?

As part of Paris Arbitration Week 2022, I am proud to organise a webinar on the European Commission’s proposal for a directive on corporate sustainability due diligence. The proposed Directive aims at fostering sustainable and responsible behaviour of businesses operating in the European Union throughout their global value chains and, in particular, at identifying, preventing, mitigating and remediating the adverse impacts of their activities on human rights and the environment in Europe and beyond. 

Taking into account, in particular, the combined pressure of the effects of climate change and of more difficult access to energy, be it for geological or geopolitical reasons, disputes will probably arise in relation to the proposed Directive’s scope and the obligations to be created.

Accordingly, the arbitration community cannot ignore this forthcoming material development.

One can hardly think of a more qualified speaker than Noëlle Lenoir to discuss these issues. Ms Lenoir is well known for holding several high-ranking positions in the French public sphere, including as the first woman and youngest Justice ever appointed to France’s Conseil constitutionnel and as Minister of European Affairs. Among her other positions, which include various senior roles in the academic and business worlds, Ms Lenoir was also a member of the French Conseil d’Etat, the Ethics Officer of the French National Assembly, President of the European Institute at HEC and taught Biotechnological Law and Ethics and European law at Columbia Law School. In addition to her private legal practice (which encompasses constitutional law, competition law, data protection, compliance and ESG), Ms Lenoir is also currently vice president of ICC France and a member of the French Academy of Technologies and of the American Law Institute.
